Again following the advice of her college counselor, she did not identify her parents on her application, since she was estranged from both of them (she describes them both as "biological"[3][2]). I really appreciate it. And at the time I was more in panic mode than like, let me step back and look at this logically, theres absolutely no case, this is an intimidation tactic to try to silence me and sign this NDA and withdraw from the Rhodes and agree to whatever terms they wanted me to agree to you. Nothing I have is persuasive to these people. MF: They have since claimed that that is not what they [laughs] insinuated, I believe my former lawyer spoke to it in The New Yorker piece. And so where is your story now? Why were you in the hospital that long? My understanding is there were two anonymous emails. RG: And so where is your story now? Its, in my opinion, because they get overlooked and the kids like me are kind of rendered invisible by the privileges of our biological families. [4] After gathering all the evidence, they approached Driver's widow, Roxanne Logan, who had not been informed of the accessibility issues and delays involved in her husband's death; in fact she had been given the impression he had been evacuated from the building almost as soon as he began experiencing symptoms. Mackenzie Fierceton described herself as s a "queer,. She entered foster care only at the age of 17, after making a complaint of abuse against Dr. Morrison a complaint that a court later found not to be credible. Since we began the Reshuffled journey, any mention of foster care grabs my attention, the same with Tracy. Like, they want to curate a diverse experience for their well-off students, so that they can say that they had this diverse experience in college . Mackenzie Fierceton: Yeah. Period." "[3][l], The Chronicle story led to nationwide coverage,[17][18] most of which framed the narrative as Penn and the Rhodes Trust had in their reports, depicting Fierceton as yet another exposed fraud. And because poverty and abuse are so pervasive in society and particularly in a country that has such a minimal social safety net and has so much violence. Thats the reality of it, but we dont want to think of it that way. If you speak, Im going to disconnect you from the call. And my biological family did not fit those stereotypes, and I think that was really hard for people to process. Penn, by questioning so much of Fierceton's story, was making itself "complicit in a long campaign of continuing abuse", she added. Its just so obvious that you fit the criteria for low-income, but it seems like they feel like you dont fit it in the spirit of how they want it. Fierceton finished her Whitfield education on a scholarship while living in foster homes. Thats all it takes to support the journalism you rely on. She, about 10 years ago, she wrote a comment I think on a Gawker post or something like that that we ended up then re-publishing as an essay at The Huffington Post about, and it was about her life in poverty, and it went viral, millions of people read it, extremely well-written piece. One possible explanation for this depressing story is that Mackenzie Fierceton fraudulently accused her own mother of gravely abusing and attempting to kill her, spent 22 days in the hospital to . [2] Ruderman's story, published the next day, began:[13]. She was then admitted to Penn on a full scholarship, where she identified as a first-generation low-income (FGLI) student despite her background due to her estrangement from her parents and lack of financial support from them, a classification she says Penn officials told her was acceptable in those circumstances. In the transcript, I wrote it was really just focused on: What happened the night you went into foster care? And she was shocked. But I guess I cant say for sure. And I dont remember all of the questions, but it was a really intense, rapid fire of really difficult and challenging questions. Right. In addition to the complaint she had made against Lovelace, a similar complaint to police that her mother was abusing prescription drugs also did not yield any evidence to support it. [2], Local police were called. [2], During her high school years, Fierceton has alleged that her mother subjected her to emotional and physical abuse, the latter enough on more than one occasion to require hospitalization. So they didnt ask about that in this meeting. RG: So how is a person who is filling out this application supposed to know what definition youre supposed to use? [2] Her father, Billy Terrell,[1] had been an actor in soap operas. Im part of a wrongful death lawsuit that was filed in August, 2020. What about Rhodes? She was abused, but there is not enough blood." It didnt, though, to the University of Pennsylvania. And so if its a well-educated white girl from a private school, thats way too close to home for a lot of these elites. And eventually they filed a big wrongful death lawsuit in August 2020. In the transcript, I wrote it was really just focused on: What happened the night you went into foster care? And I think that she kind of encompassed a lot of the stereotypes that people, and also the Penn administrators have about what FGLI students are when in reality, those of us who are part of the community know that theres so many shapes and sizes of FGLI students. RG: First of all, thats one box? [7] The charges against Lovelace were dropped later for lack of evidence. And thats actually one of the things that, if there was any doubt whatsoever about this story, in some ways it was settled by that. We started building this, and this is exactly who we built it for. MF: She definitely asked some questions about it. The award brings the number of Penn Rhodes Scholars to 31 since the scholarship's inception in 1902. What kind of a group is that? "[I]t was probably from someone in my biological family," she told The Intercept, "because it had photos of me; it had very specific information that very few people would haveand I don't think many people would have random childhood photos of me. But I think a lot of it stems from the current policies and practices of federal and local funding and what kind of programs theyre funding for kids. They demanded that the university remove the notation from her file. Its just so obvious that you fit the criteria for low-income, but it seems like they feel like you dont fit it in the spirit of how they want it. Like I just havent, really, there to be a lot of information about me publicly. At Norton's request, a fellow political science colleague, Rogers Smith, who while at Yale had chaired that university's undergraduate disciplinary committee, agreed to represent Fierceton during what he called "a very unusual process". [Laughs.] "[2][j], The evening the story ran, Ruderman called Fierceton back and told her she had received some anonymously written emails casting doubt on what she had written. And its no offense its not like the most profound . Penn student and Rhodes Scholarship recipient Mackenzie Fierceton filed a lawsuit against the University following its investigation into allegations that questioned her status as a first-generation, low-income student and survivor of abuse.. So Rachel had it and Penn disputed it. And if you read it aloud, its almost exactly the length of the phone call. This made Fierceton feel as if she were being watched for anything she did that could be used against the state's case by her mother. Like one of them was describing a biological child in a house as another foster child, and something about a half-brother or something. What were those and how were those errors kind of deployed against you? [2][4], After she had recovered from her seizure incident earlier that year, fellow students told her how difficult it had been for first responders to get to the basement of Caster Hall, where SP2 is based and holds most of its classes, and how difficult it had been to get her out. In addition it offered details of what its own investigation had concluded about Fierceton's childhood and adolescence that led OSC to believe it was likely that she had exaggerated or fabricated outright her claims about her mother. [2], Morrison retained William Margulis, a former member of Whitfield's board who had sent four of his children there, including one of her daughter's classmates, as her attorney. And that is, I felt very defeated too. [Laughs.] She definitely asked some questions about it. Penn filed a 130-page response two weeks later, denying all her allegations of wrongdoing and saying that the university officials and co-defendants who had investigated the case were unaware of the Driver lawsuit when they did. RG: I think for a lot of us, we have to sort of other poverty and abuse and put it in a box, partly, to protect ourselves. That evening that the article came out is when I got a call from the reporter saying: I got this anonymous email that said X, Y, Z, and I wanted to let you know. Mackenzie Fierceton, a graduate student at the University of Pennsylvania, has won the prestigious and extremely competitive Rhodes Scholarship, which will allow her to study at Oxford in November 2020. Ultimately she decided to apply for the scholarship, in which she proposed to expand on the subject of her undergraduate thesis, the intertwining of the foster care and juvenile justice systems, to "continue to try to move forward in my life. Cause I had assumed it was her. [14], The publicity led 150 Penn students to stage a walkout from classes to demonstrate in support of Fierceton. But it doesnt mean you were always low-income, just that you are now. Her mother was arrested and charged with child abuse, but those charges were later dropped; state courts later expunged the arrest and ordered her removed from the state's child-abuser registry. MF: Yeah, so Penn First for the whole FGLI community. [2][3], Fierceton had initially expected it would be easier for her to transition to college life than it was for other students, since she was not leaving a family behind at home. Aviv tells the story of Mackenzie Fierceton, a former student at the University of Pennsylvania. Like some students do have a story, more like me where they had some kind of separation from their family; other students their parents were doctors or lawyers or Ph.D. students in other countries, but then they came here and their degrees no longer, essentially, counted or people who are just first-generation and not necessarily low-income or people who are low-income, but not first-generation. Its practically half of Americans, or more. RG: And all of us, no matter what our situation, are not completely safe from it. And it became pretty clear to me that they had spoken to Carrie and or seen medical records. Her admission to Oxford was unaffected, and she began her graduate studies in sociology there later in the year, with a Penn professor covering her tuition. Cause then you cant think that it could be you. Mackenzie, for her part, was accepted to the University of Pennsylvania and, in her sophomore year, won a Rhodes Scholarship. Who would hold party elites accountable to the values they proclaim to have? Are we going to see these injuries? Right. Morrison told White in an email. Fierceton was released after four days. How much research has been done on the foster-care-to-prison-pipeline? She is suing Penn for defamation, arguing its real goal in investigating her was to discredit her as a witness in and retaliate for a wrongful death suit filed against the university by the widow of a fellow student which Fierceton instigated. First of all, thats one box? Thank you so much for having me. She kept a journal, writing that she was in so much pain from her bruised ribs that she could barely breathe. A trial was held in early 2019 at which she, Fierceton, a psychologist and a DSS investigator testified. And youre getting instruction from a university official that that's how you're supposed to fill it out, that's what the definition says online. Mackenzie Fierceton grew up poor, cycling through the rocky child welfare system. Mackenzie told the police her mother had pushed her down the stairs and struck her in the face. Enough bruises? who was, I believe now, the acting provost. MF: At first there was actually, there was contention. And I think its true. And thats an unfortunate reality so many survivors experience, not having a lot of documentation. They took photographs of Caster's staircases and elevators, and interviewed witnesses and some of the Penn paramedics who had responded. In her reading, Tracy came across an article that congratulated Mackenzie Fierceton, a University of Pennsylvania graduate, on being named a Rhodes Scholar. In November 2020, Mackenzie Fierceton was one of just 32 students to be awarded the Rhodes Scholarship to study at Oxford. I think [its] called Penn First, I believe, and it seems like you socially spent a lot of time with them? RG: Right. "You can't couch-surf in a pandemic", Norton said. And we do know for sure that she was in touch with the university. [2], Some of those Morrison talked with did believe her; a classmate of Fierceton's recalled people likening her to the protagonist of the film Gone Girl, about a Missouri woman who disappears in order to avenge herself on an adulterous husband, whom she makes it appear killed her. How do I do that in a succinct way when theres a very short word count and youre trying to fit everyones experience in?And so I didnt really think about: Oh, I need to say: This foster sibling who was in the foster care system. Yeah, it was, things like that where I simplified all of these foster kids that youre living with a biological family who have kids, which I would say are foster siblings. Youre welcome to talk to Penn Police or their Division of Special Services or the Womens Center, or any program that Ive been involved in, or people that have been involved in supporting me who can corroborate this. Theyre not on a website. [2], Two weeks after the New Yorker article was published, Fierceton gave an interview to The Intercept's Ryan Grim for an installment of the Deconstructed podcast. "She was a foster child, but not for long enough. Morrison had told the admitting physician that she had not been present when her daughter was hurt but believed she had fallen down the stairs in the house, which the hospital accepted as the likely cause, even though her fearfulness was also noted. Detective Carrie Brandt, who had been planning to follow up on the hotline report at Whitfield that day, instead interviewed Fierceton at the hospital. RG: And so, like I mentioned earlier, I dont want to go over too much of the history that led up to your battle with Penn and with the Rhodes trust, because people can find that in The New Yorker article that came out recently, you went over that in some pretty decent length; in Katie Courics podcast in a recent interview there. So they didnt ask about that in this meeting. [3] "Mackenzie may have centered certain aspects of her background to the exclusion of othersfor reasons we are certain she feels are validin a way that creates a misimpression," the report said. Whereas white parents, a lot of times, it is much harder the bar is much higher to remove them from their homes because their whiteness or possibly class privilege or whatever identities that they have that might not fit a social worker or judges or whoevers involved perception of whose kids should be in the foster system. When they did, they were unable to get stretchers or backboards down Caster's stairways or elevators as there was insufficient space. [2], Brandt noted that Morrison never asked about, or expressed concern for, her daughter's well-being. Uh, my lawyer. [2], In the early 2000s the couple went through a protracted divorce during which a guardian ad litem was appointed to represent their daughter's interests at the custody hearing. When she was a teenager, she showed up bloodied and bruised at her elite private school. Both reports refrained from expressing an opinion about the truth of her abuse allegations. RG: so that people have the background there. And you experienced that yourself, right? RG: And so when you applied for your masters in social worker or sociology? Fierceton wrote to SP2 dean Sara Bachman complaining about the interview, saying she felt "worthlessness, hopelessness, and shame" for a week afterwards. [2], At the beginning of April,[5] after she came to school with a black eye that showed through the concealer she put over it, she was taken to see the wellness director, who asked what had happened. RG: She, about 10 years ago, she wrote a comment I think on a Gawker post or something like that that we ended up then re-publishing as an essay at The Huffington Post about, and it was about her life in poverty, and it went viral, millions of people read it, extremely well-written piece. She began to realize that she had no sense of identity. After a teacher reported what they felt was abuse, a social worker came by and your mother was able to just charm the pants off her. Penn didnt respond to a request for comment, but in its response to Mackenzies lawsuit, they write: Penn denies that there are accessibility problems with the Caster Building which contributed to Mackenzies medical emergency or to [Cameron] Drivers death. [2], A week later, Fierceton received an email asking her to attend a meeting over Zoom with Winkelstein. And we have our own specific grad school definitions. Cause then you cant think that it could be you. Right. Fierceton, according to Penn's response, had learned during her parents' divorce how to make calls to the child-abuse hotline and that teachers were mandatory reporters. Smith said he believed the university had decided before it began investigating that Fierceton's abuse allegations were false and that she had fabricated them with the goal of finding an easier way into Penn or another elite school. RG: in America. MF: Yeah. Also, there was a delay in getting the Penn Police there because they didnt know where the building was. Later in the year she wrote online that the name change gave her "ownership of her identity" and a sense of agency she had not had before in her life. You had mentioned that you actually made a transcript of your interview with Deputy Provost Finkelstein shortly after the conversation. There was, yes, disagreement, because I said there was blood in my hair in the essay, they said there wasnt enough blood or there wasnt blood or something. And even now, The New Yorker quotes a lot from my childhood journals describing my abuse. Fierceton grew up in a wealthy community and attended an elite private school in a St. Louis suburb. Attached were copies of the Missouri court orders expunging Morrison's arrest and removing her name from the DSS registry. And is it somewhat of a defense mechanism that people deploy to protect themselves? There was also the part of me that was terrified. [1] It appended both the Rhodes report and OSC's as exhibits. And that dynamic, I would say, [laughs] probably played a big part in all of this. Because Im not under any illusion that Im the typical foster kid. And now they have to face the fact that someone who looks like them, who shares all these identities with them, could be the source of all of this harm. Later, another Whitfield parent Morrison had talked to told this woman that she believed Fierceton had done this to get admitted to an Ivy League college, an idea which she found preposterous. You have a good education and youre clearly smart. on about your day, ask yourself: How likely is it that the story you just read would have been produced by a different news outlet if The Intercept hadnt done it? Like one of them was describing a biological child in a house as another foster child, and something about a half-brother or something. What were those and how were those errors kind of deployed against you? She didnt know he was in the basement. Uh, my lawyer. [2], Fierceton was accepted at the University of Pennsylvania (commonly known as Penn) on a full scholarship, arranged through QuestBridge. "Was the problem that a child who was placed into foster care and had no contact with her biological mother wasn't actually a first-generation college student? So those questions came like later on and were really a part of the initial interrogation. They had done their own investigation again, quotes on investigation and then I had submitted over a hundred pages of documents to them. And what area of it are you going to explore with your Ph.D.? When asked what she might have done differently, Fierceton told the Chronicle that while she had at some points wished she had never applied to Penn, and later considered rephrasing some of the things she wrote on her essays and applications, "[w]here I've landed is that I have a right to write about my experiences as I experienced them. Is that what sent you into a surreal state? And I suspected that it was about this anonymous email. And that was the end of it, right? I took photos of the building and sent it to them, and I was connecting them with different people who were in my class, who were in his class. "[1]:119, Dismissal of mother's charges and expurgation of records, Role in wrongful death suit against university, In its response to Fierceton's suit, Penn quotes Fierceton as telling police as soon as they entered her hospital room after her later injury about her diary and that it would tell them everything they would need to know. She didnt even know what building he had died in. A cousin who lived with the Morrisons for a while did not see any signs of abuse and believed it was possible Fierceton could have inflicted the injuries herself. MF: You know, I believe the first people who said that was the Rhodes Trust. The reporter had assumed based on her status as a FGLI student which stands for first-generation, low-income that she had been poor her entire life. And after you talked to the school, how did you get to school the next morning? The 23-year-old planned to use. I think youre right. So the Rhodes Trust ended up after their quote-investigation, and I submitted all the evidence, they ended up still recommending that my scholarship be rescinded, uh, but I had another opportunity to respond to their report, which I absolutely wanted to do. So normally the term FGLI, its just an umbrella term for both. And then the other question was: Are you the first in your family to attend college? Mackenzie Hargreaves is a fictional character from the Australian soap opera Neighbours, played by Georgie Stone. She made her first appearance on 30 August 2019. She told them she felt that would be more likely to get an unbiased answer that way. That was my personal statement. You didnt grow up in crumbling projects your entire life. Her mothers name was entered into a registry of abusers. Teachers and parents at Whitfield had donated new clothing and school supplies for her. But while OSC allowed that it may not have been Fierceton's explicit intent to deceive, she had still done so, particularly when checking "yes" on the question on her SP2 application as to whether she was the first in her family to attend college (Fierceton stands by her reliance on Penn's definitions of FGLI on the Penn Plus website and the applicable federal laws; the university says that question is "composed of ordinary words with everyday meanings, and it makes no reference to any term or definition appearing in any other publication. She told Brandt it was her mother, and asked her to keep Morrison from coming to her room. RG: And one of the main things they pointed to was that she had gone to this private school . "She has become emboldened over time, and has been successful with her evolving tale for 6 yrs. So first-generation and/or low-income, again, is the acronym. The fact that they even challenged that really does expose a lot of whats going on here because I assume in their mind, theyre saying: Well, she went to this private school; she had a nice house; her mom probably drove a nice car maybe you even drove a decent car! [2] She was also working two jobs, as a policy fellow with Philadelphia City Council and another interning in social work at Children's Hospital of Philadelphia. And thats an unfortunate reality so many survivors experience, not having a lot of documentation. If youre an independent student, then you should check yes to both boxes. But that was definitely a driving force for why I decided, ultimately, to withdraw because I felt like: OK, federal prison is no joke. She expressed some concern to Penn staff that if she won, the media attention might incite her mother and her family to attack her reputation, and expressed on a form she filed with Penn as part of the process a concern of hers that FGLI students such as herself were "pressured to be someone they were not amidst their application process." And that dynamic, I would say, [laughs] probably played a big part in all of this. And then The New Yorker adds in parentheses that a Penn spokesperson says: Yeah, well, thats not the definition that we use. [2], The fine was later withdrawn after it was found to conflict with a provision of the university's charter prohibiting the imposition of fines in cases involving academic integrity. Like, it seemed like an airtight case from my perspective. At first she went to a friend's home in Ohio and then returned to the Philadelphia area as May and graduation approached to live with a classmate's family. She is poor, but she has not been poor for long enough. Raised in Chesterfield, Missouri, a West County suburb of St. Louis, she attended and graduated from the Whitfield School in Creve Coeur. "[12] Gutmann, soon to step down from her position to serve as U.S. ambassador to Germany, had made increasing the amount of FGLI students at Penn a priority in her previous 17 years as the university's president. As in Fierceton's case, it took an hour to remove Driver from the building. Whereas a social worker comes into a poor home and looks around and sees just the normal poverty that our system has foisted on people and says: Oh, well, clearly this is somebody that needs to be stripped out of here. And I dont remember exactly what their statement was, but they disputed it. And Penn is still claiming that those are fake journals. So, yes, an article came out in the local paper saying that she had been arrested. Beth Winkelstein, at the time Penn's deputy provost, signed off on her application for the school, writing that "Mackenzie understands what it is like to be an at-risk youth, and she is determined to re-make the systems that block rather than facilitate success. How many people kind of fit that category that you interacted with, and how many kind of fit closer to your category, not just in your own interactions, but also in your research? Yeah. The fact that they even challenged that really does expose a lot of whats going on here because I assume in their mind, theyre saying: Well, she went to this private school; she had a nice house; her mom probably drove a nice car maybe you even drove a decent car! If we review your medical records, are we going to see you had broken ribs and facial injuries? RG: Like, those two things dont fit together. Fierceton wished that she had been more willing to correct mistaken impressions that she might have made and at the time "just kind of crumbled behind the pressure. RG: So I could imagine why at some point youd be like, you know what, Im just not going to keep taking Ls here. Fierceton joins Ryan Grim to discuss the saga of her battle with UPenn and why the Ivy Leagueinstitution seems to have so much trouble recognizing the complexity of poverty in America. Asked by the school's wellness director (who later told police she had seen insulting texts from Morrison on Fierceton's phone) about the reasons for the injuries, Fierceton said that she was "clumsy" but did not offer any details. At the end of the march they were addressed by Fierceton and other FGLI students. And because you were not just low-income, actually no income, other than the jobs that you were working nobody has complained about the low-income one, right? I didnt encounter many of them in the two years that I was living in foster families. Mackenzie Fierceton has lost her Rhodes Scholarship and her University of Pennsylvania master's degree is being held after an anonymous tipster called out alleged inaccuracies in her school and scholarship applications.NY Post photo composite Our grad school had no specific definitions or instructions, but I did have a relationship with the associate director of admissions at the time. And I ended up reading the comments, and the comments were just horrendous. I mean, youd been taking loss after loss, despite having the facts on your side.
